Agreement on using the services of the Internet store fabricland.com.ua

This agreement, hereinafter the "Agreement", is concluded between the Internet store fabricland.com.ua, having an address on the Internet https://fabricland.com.ua, hereinafter the "Internet Store" or "Site", and the user of the services of the Internet store, hereinafter the "Buyer", and defines the conditions for purchasing goods through Site.

1. Basic provisions

1.1. This Agreement is concluded between the Buyer and the online store at the time of placing the order. The buyer confirms his agreement with the conditions established by this Agreement.

1.2. This Agreement, as well as product information presented on the Site, are considered a public offer.

1.3. The provisions of the Civil Code of Ukraine on retail sales, as well as the Law of Ukraine "On the Protection of Consumer Rights" and other legal acts adopted in accordance with them apply to the relationship between the Buyer and the Internet store.

1.4. The buyer can be any natural or legal person capable of accepting and paying for the goods ordered by him in the order and on the conditions established by this Agreement, on the territory of Ukraine.

1.5. The online store reserves the right to amend this Agreement.

1.6. This Agreement shall be considered as published on the Site and shall be applied and interpreted in accordance with the legislation of Ukraine.

2. Product information

2.1. The product is presented on the Site through photo samples that are the property of the Internet store.

2.2. The product may differ from the photo samples, but it will definitely correspond to the characteristics of the selected item.

2.3. Each photo sample is accompanied by text information: price and description of the product.

2.4. At the Buyer's request, the manager of the online store can provide (by phone or e-mail) other information necessary and sufficient, from the Buyer's point of view, for him to make a decision to purchase the product.

2.5. The price of the goods indicated on the Site can be changed unilaterally by the Internet store, but not after the order has already been placed by the Buyer.

3. Procedure for purchasing goods

3.1. The buyer has the right to place an order for any product presented on the Site. Each product can be ordered in any quantity. The order can be placed by the Buyer in the following ways: made by phone or placed independently on the Site.

3.2. After placing the order, an invoice is sent to the Buyer's e-mail, confirming the acceptance of the order, indicating the names of the selected goods and the total amount of the order, which is an integral part of this Agreement. Next, the manager of the Internet store contacts the Buyer (by phone or e-mail) to receive confirmation of the order.

3.3. If the product is not in stock, the manager of the online store must notify the Buyer (by phone or e-mail).

3.4. The buyer has the right to make a preliminary order for goods that are temporarily out of stock by making a prepayment in accordance with the procedure agreed with the manager of the online store. When paying for the goods in advance, the order is processed only after the advance payment has been made.

3.5. If the product is not available, the Buyer has the right to replace it with another product or cancel the order.

3.6. The Buyer has the right to refuse the ordered product at any time before it is sent to the Buyer, having notified the Online Store in advance (by phone or e-mail).

4. Delivery and acceptance-handover of goods

4.1. Delivery of the goods ordered in the Internet store, in the agreed quantity and assortment, is carried out by the Internet store throughout the territory of Ukraine.

4.2. Costs for product delivery are negotiated with the online store manager.

4.3. The shipment and delivery of the ordered goods is carried out within the terms agreed with the Buyer.

4.4. The buyer is obliged to accept the ordered goods in the presence of the courier of the Internet store according to the quantity, quality, assortment and completeness of the goods.

4.5. The fact of acceptance of the goods by the Buyer is the payment of the goods.

5. Payment for goods

5.1. The procedure and terms of payment for the ordered goods are negotiated by the Buyer with the manager of the Internet store.

5.4. The goods are paid only in hryvnias.

6. Return of goods

6.1. The buyer has the right to refuse the goods after receiving them. The return of the product of proper quality is possible if its product type, consumer properties, as well as a document confirming the fact and conditions of purchase of the specified product are preserved.

6.2. The Buyer has no right to refuse the goods of proper quality, which have individually defined properties, if the specified goods can be used exclusively by the Buyer.

6.3. If the Buyer refuses the goods, the Internet store returns to him the amount of money paid for the goods, after deducting the amount of the Internet store's expenses related to the delivery of the goods to the Buyer and the removal of the goods from the Buyer, no later than ten days from the day the Buyer presents the corresponding claim.

7. Other

7.1. The online store reserves the right to expand and reduce the product offer on the Site, regulate access to the purchase of any goods, as well as suspend or stop the sale of any goods at its own discretion.
